SmileScan AI Terms of Use
Last updated: August 18, 2026 Effective: August 18, 2026
1. Who these terms are with
These terms are an agreement between you and Dentist Owners LLC, an Oregon limited liability company, 7546 NE Shaleen St, Hillsboro, OR 97124 ("SmileScan", "we", "us"), covering your use of the SmileScan AI iOS app.
By using the app you accept these terms. If you do not accept them, do not use the app.
2. What SmileScan is, and what it is not
SmileScan rates the cosmetic appearance of a smile for entertainment and self-improvement. It produces a score out of 100 and short, encouraging notes.
SmileScan is not dental or medical advice, and it is not a diagnostic tool. It does not detect, diagnose, screen for, or treat any condition, and it is not a substitute for a licensed dentist or physician. It cannot tell you whether anything is wrong. See a licensed dentist for any health concern, and do not delay seeking care because of anything this app shows you.
No professional relationship. Using SmileScan does not create a dentist-patient, provider-patient, or any other professional or fiduciary relationship between you and Dentist Owners LLC, its members, managers, or employees, or any dental practice affiliated with any of them. No one reviews your photos or your scores. The output is produced entirely by an automated system.
The score is a subjective, AI-generated aesthetic judgment. It will vary with lighting, angle, and expression, and two photos of the same smile can score differently. Do not treat it as a measurement.
3. Who can use it
You must be at least 17 years old, or old enough to consent to this kind of service where you live, whichever is higher. If you are under the age of majority where you live, a parent or guardian must agree to these terms on your behalf.
4. Your photos
You keep all rights to the photos you take. You grant us only the narrow licence we need to process a photo in order to score it, for as long as that request takes and no longer.
You agree to scan only photos you have the right to scan. Do not scan another person without their permission, and do not scan a photo you do not own.
How photos are handled, including that we never store them and that OpenAI acts as a subprocessor, is set out in the Privacy Policy at https://smilescan-legal.pages.dev/privacy.
5. Acceptable use
Do not:
- attempt to use SmileScan for any medical, diagnostic, or clinical purpose
- upload photos of other people without their permission
- upload unlawful, abusive, or sexual imagery, or imagery of minors in any context that is not a parent scanning their own child with their involvement
- attempt to access our scoring service other than through the app, or automate, scrape, resell, or overload it
- reverse engineer the app except to the extent that law says you may
We may rate limit or block access that looks abusive, and we may stop providing the service to anyone who breaks these rules.
6. Subscriptions and payment
SmileScan offers optional auto-renewing subscriptions:
- Weekly: $6.99 per week, following a 3-day free trial where offered
- Annual: $39.99 per year
The price shown in the app at the moment of purchase is the price that applies in your region, and it is what governs.
- Payment is charged to your Apple ID at confirmation of purchase.
- Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel a subscription in your Apple ID settings at any time, and cancellation takes effect at the end of the current period.
- If a free trial is offered and you subscribe during it, any unused portion of the trial is forfeited when you purchase.
Refunds are handled by Apple, not by us. We cannot issue refunds for App Store purchases. Request one at https://reportaproblem.apple.com.
7. What premium includes
A subscription unlocks the full six-dimension breakdown, the improvement plan, and unlimited scans. Features may change as the app develops. If we remove something significant from an active paid plan, we will say so in advance.
8. Availability
We provide the app as it is. We do not promise it will always be available, uninterrupted, or error free, and scoring depends on third-party services we do not control.
9. Feedback
If you send us ideas, suggestions, or feedback, you agree we may use them without restriction or compensation. This does not give us any rights to your photos, which are covered by section 4.
10. Disclaimers
To the fullest extent the law allows, the app is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that any score is accurate, reliable, or fit for any purpose, including any health-related purpose.
Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
11. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill.
Our total liability arising out of the app is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars ($50).
Some jurisdictions do not allow these limits, in which case they apply only as far as permitted.
12. Indemnification
You will defend and indemnify Dentist Owners LLC and its members, managers, and employees against third-party claims, and the reasonable costs of those claims, arising out of: (a) a photo you scanned without the right to do so, including a photo of another person taken or used without their permission; (b) your breach of these terms; or (c) your use of the app in violation of law. We may take over the defense of any claim covered by this section, and you will cooperate if we do.
13. Changes to these terms
We may update these terms. If a change is material we will give notice in the app or on this page before it takes effect. Continuing to use the app after that means you accept the change. Material changes to section 16 (arbitration) do not apply to disputes that arose before the change.
14. Ending this agreement
You can end it at any time by deleting the app. We may suspend or end access if you break these terms. Sections 2, 4, and 9 through 12, and 15 through 18, survive.
15. Governing law
These terms, and any dispute arising out of them or the app, are governed by the laws of the State of Oregon and the Federal Arbitration Act, without regard to conflict-of-law rules. For anything section 16 does not send to arbitration, you and we consent to the exclusive jurisdiction of the state and federal courts located in Washington County, Oregon.
If you are a consumer, nothing in these terms removes rights you have under the mandatory consumer law of the place you live.
16. Dispute resolution: arbitration agreement and class-action waiver
Please read this section carefully. It affects your rights.
(a) Talk to us first. Before filing any claim, you agree to send a written description of the dispute to copersian9@gmail.com and give us 60 days to try to resolve it with you informally. Most issues get fixed this way. We agree to do the same before bringing a claim against you.
(b) Binding individual arbitration. Any dispute arising out of or relating to these terms or the app that is not resolved informally will be settled by binding arbitration between you and us on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted by a single arbitrator, in English, by videoconference or telephone, or if an in-person hearing is required, in Washington County, Oregon, or another location we agree on. Payment of filing, administration, and arbitrator fees is governed by the AAA's consumer rules. Judgment on the award may be entered in any court with jurisdiction.
(c) What this replaces. You and we each waive the right to a trial by jury and the right to litigate in court, except as provided in (d).
(d) Carve-outs. Either party may (1) bring an individual claim in small claims court, and (2) seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property or to stop unauthorized access to or abuse of the scoring service.
(e) Class-action waiver. All disputes must be brought in the parties' individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding. If this paragraph (e) is found unenforceable as to a particular dispute, then this entire section 16 is void as to that dispute, which will proceed in the courts named in section 15.
(f) Coordinated filings. If 25 or more demands for arbitration raising similar claims are filed against us with the assistance or coordination of the same or related counsel, the parties agree the demands will be resolved in staged proceedings: the AAA will administer an initial set of up to 10 cases selected in equal number by each side, and the remaining cases will not be deemed filed, and no fees on them will be due, until the initial set has been resolved and the parties have had 60 days to discuss resolution of the rest. Statutes of limitation are tolled for cases awaiting their stage.
(g) Opt-out. You may reject this arbitration agreement, without any penalty, by emailing copersian9@gmail.com within 30 days of first accepting these terms, with the subject "Arbitration opt-out" and a statement that you opt out. If you opt out, or where this section is unenforceable, disputes proceed in the courts named in section 15.
17. Apple
These terms are between you and us, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
18. General
If any provision of these terms is found unenforceable, the rest remain in force. These terms and the Privacy Policy are the entire agreement between you and us about the app. We may assign these terms as part of a merger, acquisition, or sale of assets; you may not assign them. A failure to enforce a provision is not a waiver of it.
